Prosecution questions credibility of defense’s expert witness in Cusick trial

OTTAWA – Cross examination of a forensic pathologist concluded the day in the trial of a former Ottawa fireman accused of murder. 52-year-old Kenneth Cusick is accused of drowning his wife Tracy in a toilet in 2006.Dr. Christopher Milroy, who reviewed both of Tracy’s autopsy reports, told jurors that injuries related to the neck that were reported in the second autopsy could have derived from dissection in the first autopsy. Prosecution argues that the fractures found in the trachea were due to force trauma.
Milroy says its not uncommon for the neck to sustain injury while performing an autopsy due to its frailty.  During cross examination, State’s Attorneys tried to put Milroy’s credentials into question by leading him to concede to a month suspension earlier this year by the hospital that he works for in Canada. Prosecution also lead Milroy to say that a properly done autopsy should have avoided any fractures to the neck. Defense will continue with their expert witnesses on Thursday at the LaSalle County Courthouse.
